The artist may argue that the work is sufficiently transformative when viewed in context of Mr. Beasley&#039;s canvas (a.k.a. his body).  If the same artist who drew the &quot;W&quot;, or the variation thereof, as it appears on Mr. Beasley, also drew the rest of the tattoos, his transformative argument may even garner a little more persuasive strength.  (Not a very persuasive agrument) He would argue that this restraint creates a chilling effect.  The only chilling the supreme court wants to do is keeping the bottle Mad Dog 20/20 on ice after a landmark decision.  Maybe MLB should procure a tattoo licensee.  Now, this is where the MBA&#039;s step in and say &quot;Any exposure is good exposure, maybe Beasley fans will go out and buy Nationals&#039; gear.  This is an amazing and most importantly &#039;FREE&#039; form of advertising.&quot;  Somebody call the Game and tell him we want our Dodgers Logo back.
