Curly W Tattoo?!>

Tim McGraw might sport the occasional curly W baseball cap, but Miami Heat forward Mike Beasley sports a permanent curly W with a tattoo on his right forearm. Is he really a Nats fan too?

It’s common for athletes in other sports to wear ballcaps and get tats with the logo of their home city. Except in a few cases (NY, maybe LA), I doubt they care very much about the baseball team.
If you asked Beasley to name three players on the Nats I’d be extemely surprised if he could.

He also has the DC alternate logo right under the curly W. I can’t read the word to the left of the DC, though.

Does MLB get a cut of that licensing deal? The MBAs at MLB, Inc. need to get on that.

The MBAs? More like the Esq’s. And it ain’t no licensing agreement either. If anything, it’d be a copyright violation. Good luck winning that suit though since he’s not trying to make any money off of “using” it.

What’s a Nats fan? I’ve heard 9,000 televisions are left on C-SPAN when people fall asleep and it switches over to MASN-2, but I’m not sure such a thing exists.

While you are correcting everyone.. Shall I point out that reproduction alone w/o intent to profit is a copyright violation… and there are statutory damages. Though, the tattoo artist, presumably did make a profit, and he did the reproduction.. so there you go if you want to sue someone.

I think it’s legit. And the Nationals should be paying him to market for the team. A little cross-market promotion couldn’t hurt.

Tread lightly, possible first amendment protection. The artist may argue that the work is sufficiently transformative when viewed in context of Mr. Beasley’s canvas (a.k.a. his body). If the same artist who drew the “W”, or the variation thereof, as it appears on Mr. Beasley, also drew the rest of the tattoos, his transformative argument may even garner a little more persuasive strength. (Not a very persuasive agrument) He would argue that this restraint creates a chilling effect. The only chilling the supreme court wants to do is keeping the bottle Mad Dog 20/20 on ice after a landmark decision. Maybe MLB should procure a tattoo licensee. Now, this is where the MBA’s step in and say “Any exposure is good exposure, maybe Beasley fans will go out and buy Nationals’ gear. This is an amazing and most importantly ‘FREE’ form of advertising.” Somebody call the Game and tell him we want our Dodgers Logo back.
